In New York City, the property owner is responsible for keeping the adjoining sidewalk in good repair. If a City street tree caused the damage at a one-, two-, or three-family home, the NYC Parks Trees and Sidewalks Program may cover it, so check that first.
There’s no fine. But if repairs don’t start within 75 days of receiving the notice, NYC DOT can hire its own contractor, and the Department of Finance will bill you for that work.
Replace every flag marked on your inspection report under a DOT sidewalk permit, then request a Sidewalk Violation Dismissal inspection through 311. The violation closes only after DOT inspects and approves the repair.

No. NYC DOT states that a sidewalk permit does not extend the 75-day period to start repairs, so it’s best to call as soon as the notice arrives.

Smaller sidewalk jobs are often finished in a day or two, while larger frontages take longer. New concrete usually needs about a day before foot traffic and about a week before cars drive on it. We’ll give you a schedule with your quote.
